The SIU has concluded that a city police officer did not use excessive force in carrying out an arrest of 54-year old Tim Mitchell in the evening hours of March 26th this year.
Police had been responding to a 9-1-1 call and a domestic dispute and upon arrival its reported that police found broken glass, blood on the floor, damaged appliances and items strewn about.
SIU Director Tony Loparco says the officer was carrying out a lawful arrest for a breach of a recognizance for alcohol consumption.
It’s reported that Mitchell resisted arrest and that after a warning he would be struck if he continued to resist while he was pinned down on a couch, the officer delivered a single punch to the man’s left side just below the armpit.
Loparco added the man’s rib fracture is almost certainly attributed to the strike delivered by the officer—-it was the catalyst that set in motion  a series of medical complications.
A perforated lung resulted in the release of air into his chest cavilty which in turn led to severe swelling in his chest, neck and face—-the resulting stress led to the rupture of a pre-existing gastrointestinal ulcer.
It required him to be put in a medically induced coma.
